At present working for a company in there sales department, i like were i work , we do not get any pension and holiday pay is paid at the normal flat rate and does not take into consideration any commission earned. have been told that holiday pay should include a commission calculation and that pension is now compulsory. The company employs about 30 people on a full time basis, also nobody has any type of contract , most employees have work here for longer than 12 months. Anybody with HR experience or law that can give me any pointers very much appreciated.

This commission thing intrigues me, as my income is broadly 25% salary and the rest commission, albeit I am an unusual case
My contract says that all commission is at the descretion of the company, so effectively can be with held without reason
That said I have worked for them in two stints for 18 years and have never had money held back

Holiday pay should be based on the last 12 weeks average.
Commission should be included for the 4 weeks statutory annual leave, nothing at the moment to say the additional 1.6 weeks holiday should include any commission earned

My holiday pay is only based on my daily rate . Any night out or working driver is not taken into consideration.

No idea what you mean about the commission for going on holiday. I'd imagine there is no guaranteed commission payment within your contract as based on sales. During your hols you will do well to make sales.

The company that you are employed by will have to provide a pension at some point. However that point or "staging date" is dependant upon a number of factors size as company size/Age etc.
So it is possible your company hasn't reached that date yet. Where I work there are six companies and only one of them has reached the staging date so far.
Not sure about the commission question, there was a recent court case but I don't know if it is still under appeal.
